Violations Reported
Inspectors reported that the person in charge (PIC) failed to show proper control over food safety practices. The PIC was seen washing hands in the wrong sink and not following the time and temperature rules for food safety. These actions cited that the PIC did not have active managerial control, which is required by the food code.
The report also stated that the PIC could not provide proof that the employees were trained to report illnesses or symptoms related to foodborne illnesses. The inspector noted the PIC could not explain the policy or the conditions under which an employee must be excluded or restricted due to an illness.
It was also observed that both the employee and the PIC washed their hands in a fruit and vegetable prep sink, instead of the designated handwashing sink. Corrective actions included retraining both individuals on hand hygiene. They rewashed their hands correctly, and the sink was cleaned and sanitized.
An employee was seen handling raw shell eggs and then touching ready-to-eat kolaches without changing gloves. To correct the issue, the contaminated kolaches were thrown away, and the employee changed gloves after washing their hands.
Cooked kolaches with sausage were found sitting out at room temperature (71°F) for several hours. The PIC admitted the kolaches sit out all day until sold, which is not allowed for time/temperature control for safety (TCS) foods. Following this, the kolaches were placed on time control with a discard time, and the PIC was trained on proper handling.
Inspectors found residential-use Ortho Home Defense pesticide in the facility. The PIC said that it was being used in the facility when such pesticides are not allowed in food service establishments. The PIC removed the pesticide from the facility.
