PosiGen, PBC and its Affiliates File for Bankruptcy
According to Pacer, PosiGen, PBC and its affiliates filed for Chapter 11 protection in the U.S. Bankruptcy Court for the Southern District of Texas. The solar energy company from Houston made the filing on November 24.
The company provides residential solar and energy-efficiency services to a broad range of households. The official filing mentions the names as its affiliates who have also filed for a Chapter 11 process: PosiGen, LLC, PosiGen Developer, LLC, PosiGen Holdings, LLC, PosiGen Operations, LLC, PosiGen Owner 2, LLC, PosiGen Provider, LLC, PosiGen Owner 3, LLC, PosiGen Rampart Holdco, LLC, and PosiGen Rampart, LLC.

According to Pacer, the latest bankruptcy process was initiated on November 24 through a voluntary filing by attorney Charles R. Koster.
The Chapter 11 process will allow PosiGen to develop a reorganization plan addressing its obligations to creditors. Judge Alfredo R Perez is supervising the case.
The estimated number of creditors on a consolidated basis, as shown through the official filing, is between 10,001 and 25,000. The data adds that funds will be available at PosiGen, PBC, and its affiliates for their unsecured creditors through the latest bankruptcy filing.

Texas Southern Bankruptcy Court for a joint administration of bankruptcy filings by PosiGen, PBC, and its affiliates. On the same day, PosiGen, PBC made a request to continue its Chapter 11 process as a ‘complex bankruptcy case.’
The solar energy company then submitted an emergency motion to request employment of Kroll Restructuring Administration LLC as its Claims, Noticing, and Solicitation Agent.
The company also filed an emergency motion requesting authorization to pay prepetition wages and continue employee benefit programs.
The PacerMonitor data shows that the Texas-based company filed another emergency motion requesting the court to pay prepetition wages, continue employee benefits programs, and more areas related to them. Through more emergency motions, PosiGen, PBC, requested the Texas Southern Bankruptcy Court to approve its use of utility services and payment of taxes and fees.
While representing the solar energy company, attorney Charles R. Koster submitted an emergency motion to file a Consolidated Creditor Matrix for PosiGen, PBC, and its affiliates. The attorney then submitted a Declaration of Robert Del Genio in support of the petitions and requests by PosiGen, PBC, for the first day of relief.
