The governing bodies of the affiliated companies unanimously approved the Chapter 11 filings through written consents and authorized their officers to take the necessary steps to begin the cases. The filing states that the companies evaluated their financial condition, including their debts, available cash, obligations, and other options.
The companies also asked the court for permission to use cash serving as collateral for certain secured lenders. In exchange, the lenders would receive additional protections, subject to court approval.
The court records add that the companies hired professionals to help with the proceedings. Kirkland & Ellis LLP, Kirkland & Ellis International LLP, and Cole Schotz P.C. are the general bankruptcy counsel. Triple P TRS, LLC is the financial advisor. The companies requested that the cases be combined for procedural purposes and jointly handled under the case of Noble Supply & Logistics, LLC.
